www.mepsc.in (including the applications available on any other platform) (collectively referred to as the “Website” or “Platform”), is a website controlled and managed by Management & Entrepreneurship and Professional Skills Council (hereinafter referred as “MEPSC”, “us”, “We”, or “Our”, or “Company”) having its registered corporate office at 20th Floor, Amba Deep, 14, Kasturba Gandhi Marg, New Delhi – 110001.

This Privacy Policy, as amended from time to time (the “Policy” or “Privacy Policy”), governs the Platform’s collection and use of your (“User” or “You” or “Your”) personal information.

Any Capitalized term not specifically defined herein shall have the meaning assigned to it under MEPSC’s Website Terms of Use.

MEPSC (Management & Entrepreneurship and Professional Skills Council) collects and processes personal data, exclusively for the purpose of implementing and administering various skill development programs, designed, sponsored, or supported by MEPSC, NSDC, MSDE, or other authorized government agencies. This includes activities such as the registration, assessment, certification, and engagement of trainers, trainees, training centres, assessors, industry partners and other stakeholders involved in skill ecosystem operations (collectively referred to as the “Services”).

Company does not use or share User’s information with anyone except as described in this Privacy Policy, or in relevant parts of the Platform.

This Policy shall form an integral part of the Terms of Use of the Platform and shall be read along with the Terms of Use. By using the Platform, you consent to the collection, use and disclosure of your personal information in accordance with this Policy. This Policy is governed by the laws of India irrespective of your location. By using the Website, you agree to be bound by this Policy.

1. USERS

This Website is intended for individuals of 18 years of age or more.

NOTICE TO CHILDREN UNDER THE AGE OF 18 AND THEIR PARENTS OR GUARDIANS:

We do not knowingly collect personal information from children under the age of 18. If you are under the age of 18, you must not use this Website. Please do not send any personal information including your email, name and/or contact information on the Platform. If you want to contact the Platform, you may only do so through your parent or legal guardian.

2. TYPE OF PERSONAL INFORMATION COLLECTED

A. The personal information that the Company collects about Users depends on the context of their interaction with the Company and the features that Users use. The Company also collects and retains the information including personal information provided by training partner/center on behalf of certain individuals. The personal information may be held by the Company shall include but not be limited to Name of candidate full name, Occupation, Email Id, Contact number, Job Role etc.

B. In addition to the information collected and retained by the Company as mentioned in sub-clause (A) above, the Company may automatically collect certain technical and interactional data arising from Users’ access to and use of the Platform. This data is not actively submitted by the Users but is passively generated through their engagement with the Platform.

C. Such data may be collected using standard technologies and tools, and is used solely for legitimate business purposes, including enhancing user experience, ensuring the security and integrity of the Platform, diagnosing technical issues, and for analytics and performance optimization. The collection and use of this data shall be carried out in compliance with applicable data protection and privacy laws.

D. The Company does not collect any payments information processed by third-party payment gateway providers except for payment reference number/payment status once the payment transaction is completed.

3. PURPOSE OF COLLECTION AND USE OF PERSONAL INFORMATION BY COMPANY

When providing the Services/database, Company only processes personal information in accordance with the Terms of Use and applicable laws. The Company also uses personal information from or about its Users for the following purposes:

To inform Users about skilling programs, training infrastructure, opportunities, and updates related to skill development;
To provide Users with additional services, features, or programs MEPSC believes may be relevant or beneficial;
To monitor, maintain, and enhance MEPSC’s Services, features, and database;
To understand User interaction, preferences, and needs, and personalize offerings accordingly;
To develop new services, features, programs, or promotions;
To meet applicable legal, regulatory, and contractual obligations;
To implement information security measures, detect breaches or viruses, and investigate unlawful activities or suspected fraud.
To provide User with such additional services, features, skilling program, that Company believes may be of interest to User;
To send User important information regarding the Platform, changes in Terms of Use, user agreements, and policies and/or other relevant information;
To implement information security practices and to determine any security breaches, computer contaminant or computer virus;
To investigate, prevent, or take action regarding illegal activities and suspected fraud;
To conduct market or benchmarking research and data analytics by tracking and analyzing current or previously collected personal information; and
To enhance user experience through cookies and other technical tools as described in Section 2 of this Policy.

When possible, Company will use personal information in an aggregated and/or de-identified format. Unless required or authorized by applicable law, Company will not use personal information for any other or new purpose without obtaining prior consent of User.

4. CONSENT

By visiting our Platform or by providing Your information, You consent to the collection, use, storage, disclosure and otherwise processing of Your information (including sensitive personal information) on the Platform in accordance with this Privacy Policy. If You disclose to us any personal information relating to other people, you represent that You have the authority to do so and permit us to use the information in accordance with this Privacy Policy. You, while providing Your personal information over the Platform or any partner platforms or establishments, consent to us to contact You through SMS, instant messaging apps, call and/or e-mail for the purposes specified in this Privacy Policy.

5. WITHDRAWAL OF CONSENT

You have an option to withdraw Your consent that You have already provided by writing to the Grievance Officer at the contact information provided below.

Please mention “Withdrawal of consent for processing personal information” in your subject line of your communication. We will verify such requests before acting on Your request. In the event of revocation of Your consent the Company will have the right to discontinue the provision of Services through the Platform, or access to the Platform in whole or part to You. The revocation for withdrawal of consent shall not affect the lawfulness of processing of any data or information based on the consent before its withdrawal.

6. DISCLOSURE OF PERSONAL INFORMATION

Company will not sell, rent or trade personal information to any third party. However, Company may share personal information when authorized and/or required by applicable law or as follows:

Legal Reasons and sharing with Appropriate Authorities: The Company may without prior intimation share any information collected by it including personal information with any government authority as and when such information is legally sought from the Company. Company cooperates with government authorities and law enforcement officials and private parties to enforce and comply with the applicable law, thus, the Company may access, use, preserve, transfer and disclose User’s information to government authorities or law enforcement officials or private parties as the Company reasonably determines necessary and appropriate
Availing Skilling Program Benefits: Company may facilitate skilling program floated various entities that offer benefits, monetary or non-monetary to ensure a robust skilling atmosphere. By participating in any such skilling program, User is agreeing to official rules that govern that skilling program, which may require specific requirements, including, User’s Aadhar number, bank details and other such information.
Third Party Service Providers: Company may grant access to personal information to third-party service providers such as training partners, training centers, project monitoring unit, banks etc. in connection with the performance or the improvement of its Platform and Services.

7. SECURITY PRACTICES

In compliance of Rule 8 of the Information Technology (Reasonable security practices and procedures and sensitive personal data or information) Rules, 2011, the Company has in place physical, electronic and administrative safeguards to protect User’s personal information. User’s posting and sharing of personal information through the Platform constitutes User’s acceptance of the risk that Company cannot guarantee absolute security.

Company will store and process the personal information in a manner consistent with industry security standards, and as long as necessary for the purposes described in this Policy, unless a longer retention is required by applicable law. Company has implemented technical, organizational and administrative systems, policies, and procedures to help ensure the security, integrity and confidentiality of personal information and to mitigate the risk of unauthorized access to or use of personal information. However, the Company understands that as effective as Company’s security measures are, no security system is impenetrable. Thus, Company cannot guarantee the security of Company’s database, nor can Company guarantee that information User supplies will not be intercepted while being transmitted to Company over the internet.

8. CHANGE OF INFORMATION OR CORRECTION OF DETAILS

Users are solely responsible for maintaining the accuracy of the information including personal information that they submit to the Company by writing to company on their grievances email address. If upon modifying or changing the information earlier provided to Company, the Company finds it difficult to permit access to its Services/database to the User due to insufficiency/ inaccuracy of the information, then the Company may, in its sole discretion terminate the access to the Services/database provided to the User.

9. DATA RETENTION

We retain your personal information for a period no longer than is required for the purpose for which it was collected or as required under any applicable law. However, we may retain data related to you if there is a legal obligation to retain the data; if required to comply with any applicable statutory or regulatory retention requirement by law or required for the purpose of publishing any statistical reports etc.

MEPSC shall retain personal information and associated records only for as long as necessary to fulfill the lawful purposes for which it was collected, or for a minimum period of 180 days where required under applicable law, such as in connection with government investigations, legal claims, or statutory reporting obligations.

Where MEPSC functions in any capacity as an intermediary, it shall retain user information for 180 days after account deactivation or content removal, in compliance with Rule 3(1)(h) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, or for such longer duration as may be mandated by law or competent authority.

10. CHANGES TO THIS POLICY

Please check our Privacy Policy periodically for changes. We may update this Privacy Policy to reflect changes to our information practices. We will alert You to significant changes by posting the date our Privacy Policy got last updated, placing a notice on our Platform, or by sending you an email as and when we are required to do so by applicable law.

11. GOVERNING LAW

The Privacy Policy shall be governed in accordance with the laws of India and any disputes arising out of or in connection with the Privacy Policy shall be subject to exclusive jurisdiction of courts in New Delhi, India

12. GRIEVANCE REDRESSAL MECHANISM AND CONTACT DETAILS

In accordance with the Information Technology Act, 2000 read with Information Technology (Reasonable security practices and procedures and sensitive personal data or information) Rules, 2011 and its rules thereof, if User faces any grievance with respect to this Privacy Policy, User may contact Company’s Grievance Officer as provided below:
